I completely understand why the Government have decided that within the 14-day period there should be no appeal or review, but I cannot understand why paragraph 8 of schedule 1 prohibits or prevents the judge from considering whether there is a basis for the order or retention in the first place. If someone fails a fitness test through no fault of their own and they do not qualify for ill health retirement, they will get a redeployed role or an unreduced pension.
